Overview
John Morrow has practiced in Burr & Forman’s litigation section for 35 years. His litigation practice includes personal injury, wrongful death and products liability defense, commercial litigation, and administrative law. He has experience defending a wide variety of products, including heavy truck crashworthiness and design defect claims. He has tried numerous jury and bench trials to verdict, and argued appeals in federal circuit court and before the Supreme Court of Alabama.
Also in the products area, John has advised and guided clients through nationwide product recalls. John’s general litigation experience has included representation of the National Collegiate Athletic Association (“NCAA”) in a series of unique and high profile defamation and invasion of privacy suits arising out of an NCAA investigation of the University of Alabama football program in 2001.
In 1996, John also began working with the firm’s health care section handling Certificate of Need litigation. This practice consists of presenting and opposing applications for Certificate of Need (“CON”) before Alabama’s State Health Planning and Development Agency, including trials of contested cases pursuant to the Alabama Administrative Procedure Act before administrative law judges of the agency, presenting and opposing cases before the Alabama Certificate of Need Review Board, and handling appeals of agency decisions in state circuit and appellate courts. Since 1996, John has been involved in numerous CON matters, and has tried over fifteen CON trials to conclusion, including cases involving open heart surgery services, cardiac catheterization services, ambulatory surgery services, hospital surgical services, free standing radiation therapy and cancer treatment centers, mobile lithotripsy services, magnetic resonance imaging, and general hospital expansion and construction projects.
John is a certified mediator on the Alabama State Court Mediator Roster. John is listed in The Best Lawyers in America under the categories of Commercial Litigation, Personal Injury Litigation and Product Liability Litigation. In addition, John has been selected for inclusion in Alabama Super Lawyers since 2008. He is a member of the Defense Research Institute and the Alabama Defense Lawyers’ Association. He is admitted to practice in all state and federal courts in Alabama, and the U.S. Court of Appeals for the Eleventh Circuit. While in law school John was a member of the Washington and Lee Law Review.
