An Alabama federal court recently rejected an attempt by certain merchant defendants to dismiss claims brought under the Fair and Accurate Credit Transactions Act ("FACTA"), 15 U.S.C. § 1681, et seq., on the basis of the plaintiffs' failure to allege actual damages.
