Jim Gilliam discussed the recently revised Family and Medical Leave Act (FMLA) forms from the Department of Labor (DOL) in an August 17, 2020 article for the Society of Human Resource Management (SHRM).
The revised forms, which are optional as employers can still use their own, include extensive changes requiring more specific information in notices and medical certifications. The revised health care provider certification for an employee’s own serious health condition or a family member’s condition now requires that providers submit a “best estimate” of any future treatment. “This is a big improvement,” Gilliam said, adding that this will hopefully help employers and employees set reasonable expectations for how long the employee should be out of work.
