Since the beginning of the building boom in 2005, Florida condominium associations have been riddled with issues related to the integrity of their exterior stucco coating, some of which are due to improper supervision – despite Florida law requiring general contractors to supervise and control all construction performed under their permits.

The main problem, however, stems from the lack of consistency from county to county regarding the inspection of stucco. Moreover, the Florida Building Code does not specifically require an inspection of stucco itself; and the Department of Business and Professional Regulation does not inspect stucco either: installation does not require a license.

“The Florida stucco crisis, including legitimate defective stucco work and frivolous stucco claims, has had a pronounced effect on homeowners, COAs and contractors alike,” he states.

Those involved in this crisis should be aware and seek experienced counsel to ensure their claims are properly managed.
