The article examined the growing market for hemp-infused beverages and its regulatory complexities. The 2018 Farm Bill opened the door for hemp-based products containing up to 0.3% THC, and companies are now positioning these products as alternatives to alcoholic beverages. However, despite their legality, a confusing and often contradictory regulatory landscape continues to challenge the industry. 

Addressing concerns over a possible amendment to the 2018 Farm Bill, Tucker emphasized the economic risks of a product ban. “A significant amount of capital has been invested in varieties, testing equipment, standards and implementation of policies and procedures in hemp operations,” he explained.

He further noted the economic significance of the hemp and CBD industry, which generates state and local tax revenue. Herndon warned, “[it] could be a death blow to many hemp farming operations across the country,” should regulatory restrictions increase.
