He suggested a checklist of the top 20 provisions that should be evaluated on every contract. Companies and owners who review contracts in-house should also have a similar checklist in place to minimize disputes.

“I am still surprised that contracts are signed without a full review—on projects of all sizes, from the smaller commercial tenant buildout to a multimillion-dollar, mixed-use development,” DeVries said. “With an incomplete or ambiguous set of contract documents, there is a greater chance of disputes.”
