Overview
Durham Boney is a member of the Corporate Practice Group. He regularly represents clients in business transactions with an emphasis on representing borrowers, purchasers, sellers, investors, landlords and developers in connection with both routine and complex commercial shopping center and mixed-use development real estate matters and related joint venture transactions. He also serves as agent for major title insurance companies.
Durham has represented one of the nation’s leading private real estate companies of retail owned centers in acquiring and/or developing a portfolio of more than 160 retail centers in 17 states. Representative major lease/anchor negotiation transactions include lease/anchor agreements with Target, Wal-Mart, Home Depot, Lowes Home Improvement, The Fresh Market, Lowe’s Foods, Whole Foods, Publix, Harris Teeter, Giant, Safeway, Stop & Shop, TJ Maxx, and Ross.
Experience
- Redevelopment and de-malling of the former Woodhill Mall property in Columbia, South Carolina (now known as the Shoppes at Woodhill) into a new and vibrant Target anchored center with Junior anchors such as Bed, Bath & Beyond, Cost Plus/World Market and Pier 1 Imports
- Development of a new 240,727 square foot Target anchored shopping center in Lexington, South Carolina
- Development of a contemplated 79,188 square foot Lowe's Foods anchored center in Myrtle Beach, South Carolina
- Development of a contemplated 80,566 square foot Publix anchored center in Hilton Head Island - Beaufort, South Carolina
- Development of a new 106,395 square foot shopping center known as Shoppes at Lorton Valley in Washington, D.C. - Arlington-Alexandria MSA anchored by Giant Food, Blockbuster Video and Starbucks
- Acquisition and development of a new 51,363 square foot shopping center known as Forest Park in Greenville, South Carolina anchored by The Fresh Market
- Development of a new 53,400 square foot center known as Town Center at Twin Hickory in Richmond, Virginia MSA anchored by Food Lion
- Acquisition of a portfolio of 21 shopping center properties in the Northeast with anchors such as Super Stop & Shop, Borders Books, Bob's Stores and Bed, Bath and Beyond
- Redevelopment of 334,762 square feet center in Marietta, Georgia with major retailers including Kohl's, SteinMart, PetSmart, Old Navy, Georgia Theatre, and Whole Foods
- Acquisition and development transactions for a contemplated 1,900,000 square foot development in Fairfax County, Virginia and a contemplated 2,000,00 square foot mixed-use development in Albemarle, Virginia
- Acquisition of a retail center with 429,546 feet of retail space known as Lenox Marketplace in Atlanta-Sandy Springs-Marietta, Georgia MSA with major retailers such as Publix, Filene's Basement, Dick's Sporting Goods, American Signature Home and Target
