Overview
Pam Baker has an environmental practice where she assists with the defense of state and federal environmental enforcement actions related to compliance with the National Environmental Policy Act (NEPA), Resource Conservation and Recovery Act (RCRA), Clean Air Act (CAA), Clean Water Act (CWA), and other environmental and health statutes and regulations.
She advises energy clients on the full range of environmental regulations affecting energy production, including the development and operation of renewable energy projects. She also provides counsel in complex Comprehensive Environmental Response and Liability Act (CERCLA) negotiations with the EPA and the State, as well as in matters related to brownfield redevelopment and landfill compliance.
Pam’s practice also involves representing clients before the South Carolina Department of Health and Environmental Control (DHEC) in negotiating air and water permits, voluntary cleanup contracts, and renewable/sustainable energy project permits. Pam routinely appears before the South Carolina Administrative Law Court representing clients in environmental permitting appeals.
Experience
- Ms. Baker successfully represented a local school district in fighting several challenges to water quality permits needed for the expansion and renovation of one of its high school facilities. Resolving this matter required working closely with South Carolina Department of Health and Environmental Control, Department of Natural Resources and the U.S. Army Corps of Engineers, Charleston District. The matter was argued before the South Carolina Supreme Court which ultimately ruled unanimously in favor of the school district.
- Ms. Baker has also assisted local governmental bodies and private industry in various procurement matters. She has also provided advice regarding the procurement process to local school boards and governmental bodies.
