Overview

Robert Thomas is a partner in the firm’s commercial litigation practice group, where he advocates for clients in both commercial litigation and construction law matters. These matters include contract disputes, business torts, fiduciary issues, restrictive covenants, intellectual property, and shareholder disputes. Robert also has significant experience in construction-related matters, including defect claims, delay claims, and cost issues. Robert actively litigates such disputes in state courts, federal courts, and before arbitral forums across the Southeast.

Robert’s clients reflect a wide range of industries, including manufacturers, distributors, general contractors, subcontractors, material suppliers, local colleges, banks, health services companies, architectural design firms, and construction and engineering firms.

Experience

  • Represented largest distributor of LED billboards in the United States in two separate federal court actions against two Chinese manufacturers and successfully negotiated settlement terms more favorable to client than original contracts.
  • Represented prominent architectural design firm in shareholder litigation against accounting firm that negligently provided valuation services, secured a settlement that recouped the client’s entire actual damages, and guided client through amicable resolution of potential shareholder claims.
  • Represented architectural firm defending against retaliation, discrimination, and defamation claims brought by former employee, securing summary judgment on all claims, and successfully defending the order on appeal.
  • Successful defense of engineering firm in a multi-million-dollar theft of trade secrets case in federal court, resulting in a favorable settlement. Secured ruling by special master that plaintiff failed to identify 740 of 743 alleged trades secrets with “reasonable particularity.”
  • Represented general contractor in contract dispute with local municipality concerning delay damages, liquidated damages, and payment claims. Secured summary judgment against municipality on all claims, and successfully defended the order on appeal.
  • Successfully represented local college in a negligent construction dispute with a major Atlanta-based construction firm, securing favorable settlement for college at the close of discovery.
  • Secured summary judgment on behalf of residential general contractor and developer in fraud, negligent misrepresentation, and breach of contract case against purchaser of residence.
